capital punishment aur death penalty is executing someone as punishment for any specific crime after proper legal trial by State. India is among 46 nations which retains capital punishment, while it has been abolished by 106 nations. there have been in debate to retain or to abolish capital punishment age it violates freedom to live which is natural right of human.



capital  punishment is considered essential to protect our society. Those who favour capital punishment argues that it stops the criminal to commit heinous crime. It also delivers justice to the family of victims and  it may stop future crimes example keeping Masood Azhar and Sheikh Omar in jail cost hijack of Indian Airlines in kandhar. 


Those who consider capital punishment should ban argues that statistical evidences does not suggest any improvement cause by capital punishment. The cases of rapes etc has still being increasing with more brutalities. In addition, Many innocent may be killed due to mistake in judgement. 


 Indian Penal Code IPC prescribe capital punishment for committing murder Section 302. killing innocent members of scheduled caste and Scheduled Tribes,rape of minor child is also awarded with capital punishment under protection of children from sexual offence posco act 2012. 


Initially in India every murder was awarded with capital punishment.  law commission in its one report rejected proposal for scraping death penalty. 

 


   in view of the above it can be said that capital punishment may kill the criminal but not the crime itself.  the state is required to provide basic amenities such as education and skill development at to society to create a sense of  belongingness in the society.

Constitution is a set of document written or unwritten by which governance of a country can be carried out. Need of the Constitution: 1. It brings together people from different groups such as religion, society, philosophy etc. 2. It set the basic structure of the governing machinery of the country such as Legislature, Executive and Judiciary and maintain thier balacne. 3. It defines the power of the government and set limit to it extent. 4.
